Inihalintulad ni lead prosecutor Gerville Luistro ang impeachment trial ni dating Chief Justice Renato Corona sa paglilitis kay Vice President Sara Duterte upang bigyang-katwiran ang pag-urong ng prosekusyon sa dalawang Articles of Impeachment laban sa Bise Presidente.
Ayon kay Luistro, sa impeachment trial ni Corona, binawi rin ng prosekusyon ang ilang artikulo at nagpatuloy sa mga natitirang kaso. Aniya, kinikilala ng naunang desisyon ang karapatan ng prosekusyon na magpasya kung aling mga artikulo ang itutuloy o ibabasura.
“We recall the impeachment trial of then-Chief Justice Renato Corona, in which the prosecution likewise withdrew certain articles and proceeded on the remaining ones. That precedent recognizes the prosecution’s privilege to determine which articles to pursue and which to drop,” ayon kay Luistro.
Samantala, iginiit ni lead defense counsel Atty. Sheila Sison na magkaiba ang dalawang kaso. Aniya, sa paglilitis kay Corona, binawi ang ilang artikulo bago iharap ang mga ebidensya, samantalang sa kaso ni Duterte, ginawa ito matapos maiharap ang mga ebidensya.
“After 38 days and expenditure of government resources presenting all these witnesses and so-called ‘evidence’, and spending all of our time coming to court, is now formally withdrawing two of those articles for which they have presented evidence and we respect this decision of the prosecution... This is not fairness,” ayon kay Sison.
