Nanindigan si retired Associate Justice Adolfo Azcuna, na nagsilbing amicus curiae, na 24 senador ang dapat maging basehan sa two-thirds voting threshold sa impeachment case.
Aniya, dapat isama sa bilang ang bawat senador hangga’t miyembro pa ito ng Senado. Ang tanging exception umano ay kung siya ay namatay, nagbitiw sa puwesto o natanggal sa posisyon.
“Right now, no one is dead, no one has resigned, no one has been removed, so you have 24. So 24 is the denominator. Supposing, one is removed, or one resigns, or one dies, then the denominator becomes 23. That’s why we did not put 16 because 16 is not always two-thirds. Two-thirds of the members, not the membership,” saad ni Azcuna.
